A Eagle recorreu da decis\u00e3o inicial da Justi\u00e7a<\/a> do Rio que determinou a perman\u00eancia de John Textor no comando do Botafogo<\/a> at\u00e9 nova an\u00e1lise do processo. A manifesta\u00e7\u00e3o da empresa ocorreu dez dias ap\u00f3s o parecer em primeira inst\u00e2ncia.<\/p>\n

Na peti\u00e7\u00e3o, a Eagle Bidco contesta a decis\u00e3o inicial que anulou algumas reuni\u00f5es da SAF<\/a> feitas por Textor em julho, mas o manteve no cargo de presidente do conselho e negou outros pedidos, como o de suspens\u00e3o imediata dos poderes do americano. Al\u00e9m disso, os acionistas da empresa alegam que a decis\u00e3o de manter Textor no comando alvinegro n\u00e3o foi pedida por nenhuma das partes. Pelo contr\u00e1rio, a Eagle queria impedir que ele continuasse tomando decis\u00f5es em nome da SAF.<\/p>\n

No documento, a Eagle acusa Textor de usar a SAF<\/a> do Botafogo<\/a> para bancar seus outros clubes, com caixa \u00fanico, o que colocou a empresa em risco financeiro, com preju\u00edzo de R$ 174 milh\u00f5es e d\u00edvidas de R$ 1,5 bilh\u00e3o. Eles acrescentam que o americano pode tirar a Eagle Bidco do controle da SAF por meio de manobras jur\u00eddicas. A Eagle argumenta que Textor dissemina uma \u201cfalsa ideia\u201d de que h\u00e1 um acordo amig\u00e1vel entre as partes – o que, segundo a empresa, n\u00e3o existe.<\/p>\n

Em uma das partes do documento, a empresa alega que Textor “n\u00e3o atua em favor dos interesses da Companhia e de sua controladora; ao contr\u00e1rio, vem fazendo de tudo para implementar uma l\u00fagubre artimanha societ\u00e1ria \u2014 \u00e0 moda \u201cz\u00e9 com z\u00e9\u201d \u2014 para avan\u00e7ar na sua agenda pessoal”.<\/p>\n

Com Base<\/a> nessa justificativa, pede que o Poder Judici\u00e1rio “coloque um freio” nos abusos do norte americano ao impedir a tomada de decis\u00f5es sem autoriza\u00e7\u00e3o do diretor independente da companhia at\u00e9 a rean\u00e1lise pelo tribunal.<\/p>\n
